How to Report Copyright Infringement
If you believe that materials or content on our platform violate your copyright (or the copyright of someone you are authorized to represent), please submit a formal notice of infringement that includes the following details to the Neiteelavie Designated Agent for Copyright Complaints:
- Signature: A physical or electronic signature from the person authorized to act on behalf of the copyright holder.
- Work Identification: Specific identification of the works or materials that are claimed to be infringed.
- Infringing Material: Information regarding the location of the material you believe to be infringing, along with detailed enough data to help Neiteelavie locate it and verify the claim.
- Good Faith Statement: A statement affirming that the notifier believes, in good faith, that the material is not authorized by the copyright holder, its agent, or the law.
- Contact Information: The notifier’s address, phone number, and, if available, email.
- Perjury Statement: A statement confirming that the information provided is accurate and the notifier is authorized to file the complaint on behalf of the copyright owner.
What Happens After Receiving a Proper Copyright Infringement Notice?
Upon receiving a valid copyright infringement notice, Neiteelavie may choose to:
- Remove or block access to the infringing content.
- Notify the content provider accused of the infringement that the material has been removed or blocked.
- Discontinue the infringing provider’s access to our services if they are a repeated offender.
How to File a Counter-Notice
If the content provider believes that the material removed (or disabled) was not infringing, or if they have permission to use the material from the copyright holder, they may submit a counter-notice to our Designated Agent containing:
- Signature: A physical or electronic signature of the content provider.
- Material Identification: Identification of the material that was removed or blocked and its location before removal.
- Good Faith Statement: A statement that the content provider believes in good faith that the material was removed due to error or misidentification.
- Provider’s Details: The content provider’s full name, address, phone number, and email address (if available), along with consent to the jurisdiction of the Federal Court of the district where the provider resides or where Neiteelavie is based.
If we receive a counter-notice, Neiteelavie may notify the original complaining party, informing them that we may reinstate the removed material or stop blocking it within 10 business days. If the copyright holder does not take legal action, we may restore access to the material within 10-14 business days at our discretion.
